1. Agreement to terms
By accessing or using phpacking.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Site.
These Terms govern your use of the Site itself — informational content, RFQ submissions, sample requests, and similar interactions. They do notgovern commercial orders, which are subject to a separate Purchase Order and Sales Agreement signed at the time of order. In case of conflict between these Terms and a signed Sales Agreement, the Sales Agreement controls.
2. Who we are
The Site is operated by Jiangxi Pinhui Packing Products Co., Ltd, a company organized under the laws of the People's Republic of China, with registered address atBuilding 46, International Furniture City, Sanqingshan West Avenue, Guangxin District, Shangrao City, Jiangxi Province,China.
3. Use of the Site
3.1 Permitted use
You may use the Site to:
- Browse our product, materials, and capability information
- Submit RFQs, sample requests, and direct enquiries
- Download our publicly published guides and reference content
- Subscribe to our newsletter (optional)
- Contact us regarding genuine business opportunities
3.2 Prohibited use
You agree not to:
- Submit false or fraudulent enquiries (e.g., to consume our sales-team time without genuine intent)
- Use any automated system to access the Site beyond standard search-engine indexing
- Attempt to interfere with the Site's operation or security
- Misrepresent your identity or company affiliation
- Submit competitor-research enquiries while concealing your affiliation (you should be transparent about your role)
- Use the Site or its content for any unlawful purpose
- Reproduce, distribute, or republish substantial portions of our written content without permission (see Section 4)
4. Intellectual property
4.1 Our content
All content on the Site — including the written guide articles, product photographs, page designs, brand marks, and the PINHUI name and logo — is owned by Jiangxi Pinhui Packing Products Co., Ltd or licensed to us, and is protected by intellectual property laws.
4.2 Permitted reference and citation
You may quote brief excerpts (typically under 200 words) from our guide articles for editorial, educational, or commentary purposes, provided you attribute the source to PINHUI and link to the original article.
4.3 Prohibited use of our content
You may not republish entire articles, use our content to train large-language models or other generative AI systems without explicit written permission, mirror our content on other domains, or pass our content off as your own.
4.4 Your content
Any artwork, dielines, design files, brand assets, or other material you submit to us through the RFQ form, sample form, or direct correspondence remains your intellectual property. You grant us a limited license to use this material solely for the purposes of preparing a quote, producing a sample, or fulfilling an order you place. We do not claim ownership and do not share with third parties beyond what's documented in our NDA Policy.
5. RFQ submissions and quotes
Quotes we provide in response to RFQs are non-binding indicative quotesvalid for 30 days unless otherwise stated. Final commercial terms — including pricing, lead time, payment terms, and delivery — are established in the signed Purchase Order and Sales Agreement, not in the initial quote document.
Quotes may be updated to reflect changes in raw material pricing, currency exchange rates, freight costs, or specification changes between initial quote and PO signing. We will communicate any material changes before contract execution.
6. Sample shipments
Free sample packs we ship in response to qualifying sample requests are provided at no charge to the recipient. We reserve the right to decline sample requests where, in our judgment, the request does not represent a genuine business opportunity (e.g., requests from competitors, students writing reports, or consumers requesting samples for personal use).
Samples are reference-spec material from our standard library. They are not custom-printed pre-production samples; the latter require a signed RFQ and pre-press setup fee.
7. Disclaimers
7.1 Information accuracy
We make reasonable efforts to keep the technical content on the Site accurate and current — particularly the materials, printing, and regulatory information in our guides. However, the Site is provided "as is" and"as available". We make no warranties about the accuracy, completeness, or fitness for any particular purpose of the information published.
7.2 Regulatory and compliance information
Our guide articles about food packaging regulations (FDA, EU 10/2011, LFGB, GB 4806, BPI, TÜV OK Compost, FSC, and others) reflect industry practice as of the publication or last-updated date. They are not legal advice and should not be relied on as a substitute for qualified regulatory counsel. Regulations change; specific product-and-market combinations require specific professional evaluation.
7.3 Third-party links
The Site may link to third-party websites (regulatory authorities, certification bodies, suppliers, industry publications). We are not responsible for the content, accuracy, or practices of these third-party sites.
8. Limitation of liability
To the maximum extent permitted by applicable law, Jiangxi Pinhui Packing Products Co., Ltd and our affiliates, officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages — including lost profits, lost revenue, or business interruption — arising from your use of the Site or reliance on any information published on the Site.
Our total liability for any direct damages arising from your use of the Site is limited to a maximum of USD $100. Liability arising from commercial orders is governed by the Sales Agreement signed for that order, not by these website Terms.
9. Indemnification
You agree to indemnify and hold Jiangxi Pinhui Packing Products Co., Ltd harmless from any claims, losses, or damages (including reasonable attorney fees) arising from your breach of these Terms, your violation of any applicable law, or your infringement of any third party's intellectual property rights through your use of the Site.
10. Termination
We may suspend or terminate your access to the Site at any time, without notice, for any reason — including breach of these Terms or behavior we determine to be abusive or fraudulent. Sections that by their nature should survive termination (Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law) will survive.
11. Governing law and jurisdiction
These Terms are governed by the laws of the People's Republic of China, without regard to conflict of laws principles. Any dispute arising from or relating to these Terms shall be submitted to the China International Economic and Trade Arbitration Commission (CIETAC) for arbitration in Shanghai under the rules then in effect, in the English language.
For consumer-protection rights granted under your local jurisdiction's mandatory laws (e.g., EU consumer protection, California consumer protection), nothing in these Terms limits those rights.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be flagged by an updated "Last updated" date at the top of this page. Continued use of the Site after changes constitutes acceptance of the revised Terms.
